A special law protects customers’ rights as soon as they enter a store – whether physical or online. People can buy goods at a specified price tag and choose payment options. Not a single individual can be approached at the shop for holding an item. Additionally, one has a right to demand witnesses in case they are caught shoplifting. Meanwhile, the shop owners can choose what type of services and goods to sell, oversee daily operations, and manage planning.
The attorney suggests four ways of downgrading shoplifting charges. Primarily, if the stores want to charge a potential robber, they must challenge the circumstances. In case there is no objective evidence one has a reason for stealing an item, they cannot file for robbery (“Ways to have a shoplifting,” n. d.). In addition, the attorney claimed that witnesses are vital if an actual crime took place (“Ways to have a shoplifting,” n. d.). However, the non-appearance of witnesses in court may lead to case closure. Moreover, store owners should provide legal discoveries if they want to prove the robbery. These may be witnesses’ accounts, surveillance camera records, or other physical evidence. Finally, plea negotiations are the right way to solve the problem since the case trial may linger due to a defendant’s resistance or other factors.
If I were the store owner and had to deal with a shoplifter, I would ensure all surveillance cameras work properly so I could provide tape in case of robbery. In addition, I would prefer criminal prosecution of shoplifters as it would guarantee tangible punishments. It would benefit my store in terms of legal property protection. I agree with the attorney’s tips as he states the fundamental stances of shoplifting and raises awareness among shop owners. It does not encourage shoplifting but rather clarifies how to protect one’s rights.
