German vs. U.S. Prison Models: Rehabilitation, Punishment, and Recidivism
Introduction
The concepts of punishment and rehabilitation are controversial in modern society. Both of the methods are reasonable, but punishment is more often practiced in the American law system. The incorporation of a German caring approach to crimes and effective policy recommendations is essential, as they impact the improvement of the nation in the future and reduce the risks of recidivism.
German Prison Model
The German and U.S. prison systems are two extremely contrasting models. German law focuses on the respect of individuals and the improvement of their socialization skills. It perceives each criminal as a person who deserves to recover from their past and seek a better life (Baraza, 2020).
Prison managers in Germany refer to the Prison Acts as a guide for their workflow (Morgenstern & Rogan, 2023). This model potentially reduces the recidivism rate due to its rehabilitation techniques (Morgenstern & Rogan, 2023). It allows more discretion and faster reintegration of prisoners into society using effective support programs.
American Prison Model
The U.S. prison system relies on punishment rather than rehabilitation. This approach fosters an aggressive environment, has no positive contribution to a criminal’s self-perception, and increases the chances of recidivism (Baraza, 2020). Americans can benefit from adopting the features of Germany’s system. Understanding the concept of resocialization and respecting prisoners’ rights would positively impact society, as criminals are a part of it.
Key differences between scholarly research findings and policy recommendations are in their purpose. Scholarly research findings focus on theoretical insights, and policy recommendations are based on practical, actionable steps. The policy recommendations for Penal Reform International could be to prioritize rehabilitation over punishment in the U.S. system, using the German experience. Another recommendation is to facilitate reintegration programs and provide prisoners with mental health support after release.
Conclusion
In conclusion, the German prison system offers effective solutions that ensure the reduction of recidivism risks among criminals. In comparison to U.S. methods, it applies rehabilitation and resocialization techniques, ensuring positive personal shifts for prisoners. Implementation of the German approach of respecting individualism and the development of after-release support groups will impact U.S. society, allowing criminals to reintegrate faster and to be peaceful members of the nation in the future.
