Memory Manipulation in Eyewitness Testimonies

Introduction

Human memory is a highly complicated process, which might become even controversial in the context of criminal sciences. For instance, the notion that it is possible to manipulate memory, create false experiences, and recover repressed memories can significantly affect the testimony process. Therefore, it is critical to continue the research on human memory to understand its effects on eyewitness testimonies in criminal and civil court cases.

In this discussion, planting false memories into eyewitnesses can either support or reject the accusation. As Elizabeth Loftus notes, a biased investigator can subconsciously manipulate the witness’s memory into false experiences (American Psychological Association, 2019). These limitations of the human brain imply that the judges might doubt the credibility of the witness’s arguments. Moreover, the difference between not remembering certain things and having completely false memories is immense. It contributes to the witness’s confidence in what they have seen and how they plan to convey their experiences in court. After all, as experts note, memory can significantly affect how the person perceive the world around them and how they react to new stimuli (American Psychological Association, 2019). It means that planting false memories in eyewitnesses not only negatively affects their testimony but might also change how they view the case and the accusation.

In summary, the topic of human memory should be carefully researched to learn more about the potential implications of eyewitness testimonies in court. The fact that it is possible to manipulate one’s experiences is a disturbing notion that can cast doubt on the credibility of the presented arguments. Therefore, professionals in the legal system should account for these issues and try to eliminate any bias and behavior that could alter the witnesses’ memories.
